Sorry, I started all of this. I saw the stencil and didn't say anything here because I figured I get the same mob linchin' reignman40 got. He's also a great guy, btw.
Anyway, I assume based one the original screen shot that IBHW didn't rip the image from the original site
http://www.zombiepumpkins.com but from another site that is now gone (for copyright infringements I assume.) Also, if you have to rip anything you can assume that it's not OK to take. The website is obviously not supplying it to visitors to use.
All images/unique creations are copyrighted to the original artist at the time of creation. If the artist chooses to release the image under the Creative Commons License, then yes you may use an image accordingly. Otherwise, you may not use the image without their permission.
It would be the same as taking a picture of Mickey Mouse and altering that to look like a Zombie. You wouldn't be able to post that image, share it with others and technically use it yourself without breaking copyright laws. Unless you had authorization from Disney. (Disney came down hard on a few stencil sites for that 2 years ago and pretty much shut them down and got rid of all of the knock offs. Only those who were paying royalties were left.)
The big issue here is having those two images available here on this site or any other. IBHW might not be profitting from it personally but Halloween.com is. The original artist said he doesn't mind members who have paid for the access to the materials to alter and create their own stencil from his work but only for personal use. I'm sure he wouldn't allow others to then distribute those, free or not, to others.
